First conviction in cyber pornography case: Accused sentenced to 6 years of imprisonment


Puri: Restoring faith over the judiciary, the SDJM Court, Puri sentenced accused of a cyber pornography case to six years of rigorous imprisonment and imposed a fine of Rs 9000 on Friday. This happens to be the first conviction against a cyber pornography case.

The State Crime Branch (CB) secured conviction of the cyber offender, Jayant Kumar Das of Puri for allegedly creating fake profile in a porn website – ‘desihunt’ in the name of a woman and posting various derogatory comments about her.

The complainant (victim’s husband) Biswajit Patnaik had alleged that after using his wife’s name in the fake profile, the accused even uploaded his telephone number  in the adult website following which Patnaik received a large number of obscene and unsolicited calls.

The FIR further alleged that the unlawful activity of Jayant was brought to light by the complainant through various newspaper publications as a journalist.

However, the CB took over the case in August, 2012 and probe into the case revealed that email account in the name Patnaik and a fake profile in his wife’s name were created by Jayant Das.

The Court convicted the accused under Sections 242, 465, 469 and 500 of IPC and Sections 66C, 67 and 67A of Information Technology (Amendment) Act, 2008.
